These General Terms of Use and Medical Services govern access to the TBIBNA, SARL platform, the use of the digital services offered, and the medical services performed by independent healthcare professionals. By using the platform, the user acknowledges having read, understood, and accepted these Terms.
TBIBNA, SARL is an intermediary technological telemedicine platform. It enables secure connections between patients and independent healthcare professionals authorized to practice in Algeria. TBIBNA, SARL provides technological tools, secure communication methods, administrative services, coordination systems, payment services, and security mechanisms. TBIBNA, SARL does not practice medicine, does not replace a hospital facility, and does not intervene in medical decisions made by healthcare professionals.
The services are intended for users located in Algeria and provided by healthcare professionals authorized to practice in Algeria. Procedures performed via the platform are subject to Algerian law, applicable health regulations, rules regarding telemedicine, and personal data protection laws.
To use the services, the user must be at least 18 years old or represented by a parent or legal guardian, be legally capable, and provide accurate, complete, and up-to-date information. Accounts concerning minors must be created and supervised by a parent or legal representative. TBIBNA, SARL may request identity and legal relationship verification elements when necessary.
Medical acts are performed exclusively by independent healthcare professionals authorized to practice in Algeria. Each professional operates under their own responsibility, in compliance with ethical rules and according to their independent medical judgment. No employment, salaried, or subordinate relationship is created between TBIBNA, SARL and the healthcare professionals.
Depending on availability and applicable regulations, TBIBNA, SARL may offer video or audio consultations, secure medical messaging, medical guidance, preventive follow-up, care coordination, and, where legally authorized and medically appropriate, prescriptions or renewals. TBIBNA, SARL does not guarantee the immediate availability of a healthcare professional.
TBIBNA, SARL does not provide emergency services, hospitalization, surgery, medical transport, continuous medical monitoring, forensic expertises, or fraudulent or illegal certificates. Remote prescriptions of benzodiazepines, opioids, controlled substances, or medications prohibited remotely by regulations or the platform's internal policy are strictly forbidden via TBIBNA, SARL.
By using the platform, the user agrees to receive healthcare services remotely via video, audio, messaging, digital platforms, or electronic tools. The user acknowledges that telemedicine has limitations, notably the lack of physical examination, potential technical interruptions, variable communication quality, and the possible need for an in-person consultation.
The user agrees to provide accurate information, use their true identity, protect their credentials, not use another person's account, not record consultations, follow medical recommendations, and respect healthcare professionals. The user remains responsible for their internet connection, their equipment, the security of their devices, and monitoring their health status.
The following are strictly prohibited: threats, harassment, sexual harassment, aggressive behavior, discriminatory remarks, inappropriate behavior on camera, indecent exposure, identity theft, forged documents, fraud, requests for illicit prescriptions, or any illegal activity. TBIBNA, SARL may suspend or close an account, refuse future access to services, or report the facts to competent authorities.
Detailed cancellation and refund rules are defined in the TBIBNA, SARL Cancellation and Refund Policy, which forms part of the applicable contractual environment. In summary, a patient may cancel a scheduled consultation free of charge up to 24 hours before the scheduled time. A patient who is absent without prior cancellation is not entitled to an automatic refund. In the event of an absence or significant delay by the professional according to the applicable policy, a refund or rescheduling may be offered.
Prescriptions are issued only when the healthcare professional considers them medically appropriate and legally authorized. TBIBNA, SARL does not guarantee the issuance of a prescription, a treatment renewal, obtaining a medication, medication availability, or a pharmacy's acceptance of a prescription. Pharmacies remain independent of TBIBNA, SARL.
Applicable rates are displayed on the platform prior to service validation. Payments are generally due before the service is provided. Completed consultations are non-refundable except in cases provided for in the Cancellation and Refund Policy. TBIBNA, SARL may investigate any suspicious payment activity, retain technical and operational elements as evidence, and cooperate with financial institutions or competent authorities in case of suspected fraud.
TBIBNA, SARL processes personal and medical data in accordance with applicable Algerian legislation, in particular Law No. 18-07 on the protection of individuals in the processing of personal data. Detailed rules regarding collection, security, retention, deletion, anonymization, user rights, and access requests are defined in the TBIBNA, SARL Privacy and Data Protection Policy.
Video, audio, or messaging consultations must not be recorded by users or healthcare professionals. TBIBNA, SARL does not systematically record the audio or video content of consultations. TBIBNA, SARL may retain operational and technical metadata such as timestamps, durations, connection statuses, technical logs, cancellation histories, payment statuses, act closure, and audit trails.
TBIBNA, SARL strives to ensure platform availability but does not guarantee the absence of interruptions, technical errors, network failures, or issues related to user equipment. TBIBNA, SARL shall not be held liable for delays or failures in performance resulting from events beyond its reasonable control, including natural disasters, widespread outages, cyberattacks, administrative decisions, telecom interruptions, conflicts, epidemics, or force majeure.
TBIBNA, SARL reserves the right to conduct verifications, request additional documents, temporarily suspend certain access, limit features, investigate suspicious behavior, or refuse a service when necessary for security, compliance, or user protection.
To the extent permitted by Algerian law, TBIBNA, SARL shall not be liable for indirect damages resulting from technical interruptions, temporary unavailability, connection problems, misuse of services, or circumstances beyond its reasonable control. Medical liability related to care acts lies exclusively with the healthcare professional who performed the medical act.
The texts, logos, software, interfaces, graphic elements, content, and distinctive signs of the platform are protected by applicable intellectual property laws. Any unauthorized reproduction or use is prohibited.
TBIBNA, SARL may suspend, limit, or terminate an account in the event of fraud, abuse, non-compliance with these Terms, threatening behavior, illegal activity, identity theft, attempted financial fraud, or security risks.
These Terms are exclusively governed by Algerian law. In the event of a dispute, the parties shall seek an amicable solution prior to any proceedings. Failing an amicable agreement, the competent Algerian courts shall have exclusive jurisdiction.
